Enacted in 2022, the Safe Sleep for Babies Act of 2021 (SSBA) declares "inclined sleepers for infants" as "banned hazardous products" under section 8 of the Consumer Product Safety Act (15 U.S.C. § 2057), see 15 U.S.C. § 2057d. The law makes it unlawful to sell, offer for sale, manufacture for sale, distribute in commerce, or import these products into the United States, regardless of the date of manufacture. The ban is effective November 12, 2022, and is codified at 16 CFR part 1310.
An “inclined sleeper for infants” is a product with an inclined sleep surface greater than 10 degrees that is intended, marketed, or designed to provide sleeping accommodations for an infant up to 1 year old.
