Commission Meeting Minutes: Decisional Matter: Proposed Rule: Safety Standard for Baby Changing Products

September 14, 2016

Chairman Elliot F. Kaye convened the September 14, 2016, 9:30 a.m., meeting of the U.S. Consumer Product Safety Commission in open session. Commissioners Robert S. Adler, Marietta S. Robinson, Ann Marie Buerkle and Joe P. Mohorovic were in attendance.

Decisional Matter: Proposed Rule: Safety Standard for Baby Changing Products

After introducing the matter and making an opening statement, Chairman Kaye asked questions of the staff. Mark Kumagai, Director, Division of Mechanical and Combustion Engineering Sciences, Directorate for Engineering Sciences ("ES"), Meridith Kelsch, GeneralAttorney, Office of General Counsel, Wioletta Szeszel-Fedorowicz, Mathematical Statistician, Division of Hazard Analysis, Directorate for Epidemiology, Patricia Edwards, Voluntary Standards Coordinator, Office of Hazard Identification and Reduction, and Hope Nesteruk, Human Factors Engineer, Division of Human Factors, ES.Chairman Kaye called for anyopening statements or questions. The Commissioners made opening statements and asked questions of the staff.

Chairman Kaye called for motions for the proposed rule. Commissioner Mohorovic moved to defer the vote on this matter for 6 months to allow ASTM to consider and complete its changes. Commissioner Buerkle seconded the motion. Commissioner Mohorovic explained the purpose of the deferment of the vote and the Commission discussed the issue. After the discussion, Chairman Kaye called for a vote on the matter. The Commission voted (3-2) to not adopt Commissioner Mohorovic' s motion. Chairman Kaye, Commissioner Adler and Commissioner Robinson voted to not adopt Commissioner Buerkle's amendment. Commissioner Mohorovic and Commissioner Buerkle voted to adopt Commissioner Mohorovic' s amendment. After voting not to defer the vote on this matter for 6 months, Chairman Kaye called for a vote on whether to approve the publication of the draft Notice of Proposed Rulemaking ("NPR") for Baby Changing Products in the Federal Register. The Commission voted (3-2) to approve publication of the draft NPR, as drafted. Chairman Kaye, Commissioner Adler and Commissioner Robinson voted to approve the publication of the NPR. Commissioner Mohorovic and Commissioner Buerkle voted to not approve the publication of theNPR. Commissioner Buerkle issued the attached statement regarding the matter.

Chairman Kaye called for any closing statements. The Commissioners each madeclosing statements. There being no other business, Chairman Kaye adjourned the meeting at 10:55 a.m.
